MRI safety decisions must be made by qualified healthcare professionals with access to complete medical records and current manufacturer guidelines.

1. Acceptance of Terms

By accessing or using the What's In Me? service (the "Service") operated by Whatsinme LLC, a Texas limited liability company ("Whatsinme LLC," "we," "our," "us"), you ("User," "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to all terms herein, you must immediately discontinue use of the Service.

We reserve the right to modify these Terms at any time without prior notice. Continued use of the Service after modifications constitutes acceptance of the new Terms. You are responsible for regularly reviewing these Terms.

2. Age Requirement

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are at least 18 years old.

3. Description of Service

What's In Me? provides access to publicly available FDA database information regarding implanted medical devices, including:

  • MRI safety classifications and conditions
  • Device identification and manufacturer information
  • FDA recall and safety alert data
  • User account functionality for personal device tracking
  • Safety card generation for user convenience

4. Data Sources and Limitations

Data Sources

Our data is sourced from FDA GUDID (Global Unique Device Identification Database), MAUDE (Manufacturer and User Facility Device Experience), 510(k) clearance database, and PMA (Premarket Approval) database. All data is considered public domain.

No Guarantee of Accuracy

WE PROVIDE NO WARRANTY REGARDING THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY DATA.

  • FDA databases may contain errors, omissions, or outdated information
  • Manufacturer safety guidelines change independently of FDA data
  • MRI safety classifications may be updated without notice
  • Data processing and automated scraping may introduce errors

5. Limitation of Liability

CRITICAL: READ CAREFULLY

WHAT'S IN ME? AND ITS OPERATORS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

  • Any medical decisions made using information from the Service
  • Any injury, death, or medical complications arising from MRI procedures or device interactions
  • Reliance on data, recommendations, or information provided through the Service
  • Missed, delayed, or inaccurate recall alerts or notifications
  • Inaccurate, incomplete, outdated, or missing device information
  • Third-party content or external website links
  • Service interruptions, technical failures, or data loss
  • Any direct, indirect, incidental, special, consequential, or punitive damages

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

USE OF THIS SERVICE IS ENTIRELY AT YOUR OWN RISK AND RESPONSIBILITY.

6. Indemnification

You agree to indemnify, defend, and hold harmless What's In Me? and its operators, officers, directors, employees, agents, and affiliates from and against all claims, damages, losses, costs, and expenses (including reasonable attorney fees) arising from or relating to:

  • Your use or misuse of the Service
  • Medical decisions made using information from the Service
  • Your violation of these Terms
  • Your violation of any law or third-party rights
  • Content you submit to the Service

7. Dispute Resolution and Arbitration

Binding Arbitration Agreement

By using this Service, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved exclusively through binding arbitration in Dallas, Texas, in accordance with the Commercial Arbitration Rules of the American Arbitration Association.

  • Number of Arbitrators: One (1)
  • Language: English
  • Costs: Each party bears their own costs and fees

You waive any right to jury trial or participation in class action lawsuits.

8. Intellectual Property and Fair Use

Our Intellectual Property

The Service, including its design, functionality, code, and original content, is owned by What's In Me? and protected by intellectual property laws.

Nominative Fair Use Notice

Manufacturer names, product names, trademarks, and device identifiers displayed in the Service are used under the doctrine of nominative fair use for identification and informational purposes only. Such use does not imply endorsement by or affiliation with the respective manufacturers. All trademarks remain the property of their respective owners.

9. DMCA Safe Harbor

User-Generated Content Protection

We operate under the Digital Millennium Copyright Act (DMCA) safe harbor provisions for user-submitted content, including photos and device information.

DMCA Notice Procedure:

To report copyright infringement, send a DMCA notice to: support@whatsinme.life

Include: (1) identification of copyrighted work, (2) location of infringing material, (3) your contact information, (4) good faith statement, (5) accuracy statement, and (6) electronic signature.

10. Account Termination

We reserve the right to terminate or suspend accounts immediately, without notice, for:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Compromised account security
  • Violation of third-party rights
  • Any reason at our sole discretion

You may delete your account at any time through your Profile settings. Upon termination, your access ceases immediately and your data will be deleted according to our Privacy Policy.

11. Prohibited Uses

You may not use the Service to:

  • Violate any applicable laws or regulations
  • Provide false information or impersonate others
  • Interfere with Service security or operations
  • Attempt unauthorized access to our systems or data
  • Use automated tools for large-scale data extraction
  • Upload malware, viruses, or malicious code
  • Infringe on intellectual property rights
  • Distribute spam or unsolicited communications
  • Provide medical advice or practice medicine without license

12. Service Modifications and Availability

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We are not liable for any modification, suspension, or discontinuation. The Service may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control.

13. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. The exclusive jurisdiction for any disputes shall be Dallas County, Texas.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will otherwise remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and Medical Disclaimer, constitute the entire agreement between you and What's In Me? regarding the Service and supersede all prior agreements and understandings.

16. Subscription Plans

What's In Me? is free to use at this time. We are not currently selling or billing for consumer or provider subscription plans. When paid plans launch, this section will be updated with refund, cancellation, and renewal terms before any charge occurs.
